Ang mga batang ipinanganak mula Agosto 3, 1988 hanggang March 18, 2004 ay maaaring ma-acknowledge ng kanilang ama sa pamamagitan ng AUSF o Private Handwritten Instrument ngunit hindi nila maaaring gamitin ang apelyido ng kanilang ama sa ilalim ng RA 9255.

  1. A petition in court may be filed in order that the child can use the surname of the father
  2. 6 years old below- the mother is the one who execute the AUSF
  3. 7 to 17 years old- the child will execute the AUSF with attestation of the mother
  4. 18 years old and above- he himself will execute the AUSF, no attestation of the mother

REQUIRED DOCUMENTS FROM THE OFFICES
  • BIRTH CERTIFICATE from the Philippines Statistics Authority (formerly NSO)
  • CERTIFICATE OF NO MARRIAGE (CENOMAR) can be applied to PSA of SM San Mateo at 2nd floor Business Center
  • PRE-MARRIAGE ORIENTATION CERTIFICATE (PD 965) MARRIAGE COUNSELING CERTIFICATE (Art. 10 of Family Code) at Super Health Center every Tuesday and Thursday at 9:00 AM
  • COMMUNITY TAX CERTIFICATE (cedula) / six (6) months residency of San Mateo, Rizal
PROCEDURES IN THE OFFICE OF THE LOCAL CIVIL REGISTRAR

Step 1  : Get application forms and checklist of requiremnts from the Civil Restry Office at the 3rd Floor of San Mateo Municipal Building. Accomplish all aplication forms fully and legibly in black pen.

Step 2  : Submit your application together with all the requirments at the RECEIVING CLERK of Civil Registry Office (APPEARANCE OF BOTH APPLICANT IS REQUIRED)

a. If applicant is between 18 and 21 years old, you must bring your parents for PARENTAL CONSENT.
b. If applicant is between 21 and 25 years old, you must bring both parents for PARENTAL ADVICE.
c. If applicant is 26 years old and above, you are of legal age.
d. If applicant is WIDOW/WIDOWER - you are to submit DEATH CERTIFICATE of demise spouse.
e. If previous marriage was ANNULLED- copy of COURT DECISION and absolute DECREE OF FINALITY from the Court.
f. If the applicant is a FOREIGNER - CERTIFICATE OF LEGAL CAPACITY issued by their diplomatic or consular officials.
g. If one/both of the Contracting parties was/were previously married and was TERMINATED by VIRTUE OF A COURT DECISION, you must submit the original or certified photocopy of the JUDICIAL DECRE OF ABSOLUTE DIVORCE, JUDICIAL DECREE OF ANNULMENT, or JUDICIAL DECREE OF NULLITY OF MARRIAGE. (Art 13 of the Family Code) as amended & Adm Matter No. 02-11-10 of SC of the Supreme Court (Memo Cir. No. 2018-18).

If your documents are COMPLETE , as determined by the Receiving Clerk, you will be given order of payment at the Municipal Treasury Office. Upon payment, you will be issued an acknowledgement/claim slip on when to comeback for the Release of Marriage License.

If your documents are INCOMPLETE, they will be returned to you together with a list of deficient documents. Complete your requirements as noted on the checklist provided then resubmit.

INCOMPLETE DOCUMENTS will not be accepted.

h. ARTICLE 34 - Exempted from Marriage License ( Husband and wife living together for more than five (5) years)
An AFFIDAVIT OF COHABITATION must be executed before a notary public

Step 3 Payment of fees at the Municipal Treasurer's Office Get your number at the information desk and wait for your number to be called / flash on screen. Pay at the cashier/ number of Window assigned on the sceen. |Return the Official Receipt / Marriage License and Fee Receipt at the Receiving Clerk of Civil Registry Office.

Step 4   AFTER 10 days Come back on schedule date of release and present your claim slip to the RELEASING OFFICER for your Marriage License.

*Marriage License is valid for 120 days from the date of issue.
